You're automatically using AS1; Flash 5 only has support for that.

I use Flash 5. Make sure you're using the AS1 FLA.
Also, make sure there is no code in your first frame, just the MovieClip of the preloader. If you're still having problems, post it on Dumping Grounds (<a href="http://www.newgrounds.com/dump">http://www.newgrounds.com/dump</a>) and I'll take a look at it.
